Thank you for purchasing products from TNA Network (“ TNA Network ”).
This Limited Warranty applies to products you purchase from TNA Network (the “Products”). For clarity, all references to “you” mean the purchaser of the Products; however, if you purchase the Products on behalf of a business entity, then “you” means that business entity.
WARRANTY
Subject to the limitations below TNA Network warrants that the Products will be free from defects in material and workmanship during the Warranty Period. For end-users, “Warranty Period” means the life of the Products, except that for hard drives and other storage devices sold to end users it means one year. For resellers, “Warranty Period” means 90 days from the invoice date for the Product.
This warranty shall be deemed void if you do not follow the claim procedures below.
This warranty is non-transferable.
LIMITATIONS
This warranty does not apply to Product defects resulting from: (1) improper installation, configuration, or use; (2) lack of proper maintenance; (3) abuse, misuse, mishandling, physical damage, or neglect; (4) accidents, acts of God, electrical issues, power surges, flood, fire, or other natural or environmental causes; (5) normal wear and tear; or (6) any modifications made to the Products by anyone other than TNA Network or a party authorized by TNA Network to make modifications.
This warranty is in lieu of all other warranties, express and implied, including the implied warranties of merchantability and fitness for a particular purpose, which TNA Network expressly disclaims. Additionally, TNA Network shall not be liable to you or any other party for any indirect, special, consequential, incidental, punitive, or non-contractual, damages, or for any interruption of or loss of business, data, income, or profits, arising out of or related to the Products. TNA Network’s liability to you and to all third parties under this warranty shall not exceed the cost of repair or replacement of the Products or the original purchase price of the defective Products. This warranty constitutes TNA Network’s sole and exclusive liability to you and all third parties arising out of or related to the Products.
Certain state laws do not allow limitations on implied warranties or the exclusion of certain damages. If these laws apply to you, then some or all of the above limitations may not apply to you and you may have additional rights. If it is found that the above limitations do not apply to you, then TNA Network’s liability shall be limited to the greater of $10 or the maximum extent otherwise permitted by applicable law.
CLAIM PROCEDURES
To exercise your rights under this warranty, you must contact TNA Network within ten days of the discovery of the effect covered by this warranty. All warranty claims must be submitted to info@tnanetwork.net along with a description of the defective Products (and serial number if applicable) and a description of the defect.
Upon receipt of a warranty claim, TNA Network may respond with instructions to troubleshoot the defect. If TNA Network is unable to resolve the failure or defect, then F TNA Network will, in its sole discretion, either repair or replace the Products with the same or better functionality (the replacement may be new, used, or refurbished). In either case, TNA Network shall provide prompt responses to valid warranty claims and, in no event, less than 30 days after the receipt of a valid warranty claim.
If TNA Network determines that you must ship the Products to TNA Network, then TNA Network will provide shipping instructions, along with account information to cover the shipping expenses. If you do not follow those shipping instructions, or if you do not ship the Products within 30 days of TNA Network providing those instructions, then this warranty shall be deemed void.
